Harbour ("we", "us", "our") is a Canadian business and we respect your privacy. This Privacy Policy explains what personal information we collect when you visit harbourmade.ca or use our subscription website service, how we use and protect it, and the choices available to you under Canadian privacy law, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and any applicable provincial privacy legislation.
We collect personal information you provide to us directly when you contact us, sign up for a Harbour subscription, or use the client dashboard. This may include your name, email address, business name, billing information, website credentials you choose to share, and the contents of any requests, messages, or files you send to us. We also automatically collect limited technical information when you visit harbourmade.ca, such as browser type, device type, approximate location based on IP address, referring page, and pages viewed.
We use personal information to deliver and improve the Harbour service, communicate with you about your account and your requests, send invoices, provide customer support, monitor and protect the security of the service, comply with our legal and tax obligations, and analyze how the site and service are used.
We collect, use, and disclose personal information based on your consent, which you provide when you sign up for the service or contact us. You may withdraw your consent at any time by contacting us, subject to legal or contractual obligations and reasonable notice. Withdrawing consent may mean we can no longer provide the service to you.
We do not sell your personal information. We share information only with third-party service providers that help us operate Harbour — including hosting, payment processing, email delivery, and analytics providers — under contracts that require them to protect your information and use it only for the purposes we authorize. We may also disclose information when required by law, to enforce our agreements, or to protect the rights, property, or safety of Harbour, our clients, or others.
Some of our service providers are located outside of Canada, including in the United States and other jurisdictions. When personal information is transferred outside of Canada, it may be subject to the laws of those jurisdictions and accessible to their courts, law enforcement, and regulatory authorities. We use reputable providers and contractual protections to safeguard personal information during transfer and storage.
We retain personal information for as long as your account is active and as required to provide the service, meet our legal, accounting, and reporting obligations, and resolve disputes. When you cancel your subscription, you may request that we delete personal information that is not subject to a legal retention requirement.
We use reasonable physical, organizational, and technical safeguards to protect personal information against loss, theft, and unauthorized access, disclosure, copying, use, or modification. No method of transmission or storage is fully secure, so we cannot guarantee absolute security.
Harbour uses a small number of essential cookies and privacy-respecting analytics to understand how visitors use our site and improve the experience. Most browsers let you block or delete cookies in their settings.
You have the right to access the personal information we hold about you, ask us to correct inaccuracies, withdraw your consent, and request that we delete information that is not required for legal purposes. You may also file a complaint with the Office of the Privacy Commissioner of Canada or, where applicable, your provincial privacy regulator.
Harbour is intended for businesses. We do not knowingly collect personal information from individuals below the age of majority in their province or territory.
We may update this Privacy Policy from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, notify account holders by email.

These Terms of Use ("Terms") govern your access to and use of the Harbour website at harbourmade.ca and the Harbour subscription website service (the "Service") provided by Harbour, a Canadian business. By using the Service, you agree to these Terms.
Harbour provides a subscription website improvement service. Subject to your subscription plan and these Terms, Harbour will review, design, build, and ship approved improvements to your website on a weekly cadence and provide a client dashboard for requests, approvals, and reports. Fair-use limits may apply for unusually heavy workloads or multiple active websites.
Subscriptions are billed monthly in advance. Fees are quoted in Canadian dollars unless otherwise noted and are non-refundable except where required by law. You authorize us to charge the payment method on file at the start of each billing cycle. You may cancel at any time; cancellation takes effect at the end of your current billing period and you keep all work shipped to date.
Fees do not include applicable taxes, including the Goods and Services Tax (GST), Harmonized Sales Tax (HST), or provincial sales taxes, which will be added to your invoice as required by Canadian law.
You agree to provide accurate information, respond to approval requests in a timely manner, and grant Harbour the access required to do the work — for example, content management system, hosting, or analytics accounts. You are responsible for maintaining the confidentiality of any credentials you share with us and for the activity that occurs through your account.
You own your website, content, copy, assets, and the deliverables produced through the Service after payment for them has been received. Harbour retains ownership of its underlying tools, templates, processes, and know-how. You grant Harbour a limited licence to use your materials only as required to deliver the Service.
You agree not to use the Service for any unlawful purpose, to infringe the rights of others, to distribute malware, or to interfere with the operation of the Service. Harbour may suspend or terminate accounts that violate these Terms.
The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, Harbour disclaims all warranties, express and implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Harbour does not warrant uninterrupted or error-free operation of the Service.
To the maximum extent permitted by law, Harbour will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill arising out of or related to the Service. Harbour's total aggregate liability for any claim arising out of or related to these Terms or the Service is limited to the fees you paid to Harbour for the Service in the three (3) months preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot be excluded under applicable Canadian consumer protection law.
Either party may end the subscription at any time. Upon termination, your access to the dashboard will end at the close of your current billing period and your account data will be retained or deleted in accordance with our Privacy Policy.
Your use of the Service is also subject to our Privacy Policy, which describes how we collect, use, and protect personal information.
We may update these Terms from time to time. Material changes will be communicated by email or via the dashboard before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the applicable laws of Canada, without regard to conflict of law principles. Any dispute arising out of or related to these Terms or the Service will be resolved in the courts of Canada.
